{"id":2944,"date":"2018-08-02T10:57:47","date_gmt":"2018-08-02T08:57:47","guid":{"rendered":"https:\/\/www.cislferrara.it\/?p=2944"},"modified":"2018-08-02T10:57:47","modified_gmt":"2018-08-02T08:57:47","slug":"pensioni-sentenza-70-2018-corte-di-giustizia-eueropea","status":"publish","type":"post","link":"https:\/\/www.cislferrara.it\/en\/pensioni-sentenza-70-2018-corte-di-giustizia-eueropea\/","title":{"rendered":"Pensions: ruling 70\/2018 European Court of Justice"},"content":{"rendered":"","protected":false},"excerpt":{"rendered":"<p>The Secretariat of the FNP-CISL of Ferrara informs pensioners, both members and non-members, that the European Court of Human Rights has rejected, declaring it inadmissible, appeal no. 10,059 against Legislative Decree 65\/2015, regarding the partial restitution of arrears, following ruling no. 70 of the Constitutional Court, which suspended pension indexation for the period 2012-2015.<br \/>\nSome pensioners, through a law firm, had filed the aforementioned appeal in Strasbourg, which had already been rejected by the Constitutional Court.<br \/>\nWithout going into the merits, the FNP-CISL, well aware that it would be a difficult process, had advised its members and non-members to submit, exclusively (by registered mail), the request to block the statute of limitations, advising against any appeal, which would be excessively costly.<br \/>\nNow the ruling of the ECHR (European Court of Human Rights) puts a definitive end to the matter.<br \/>\nAs pensioners, however, we hope that the revaluation of all existing pension benefits can take place, through a new method of calculating pension equalizations, through a discussion between the Government and Social Partners, in application of the agreement signed on September 28, 2016.<br \/>\nAs the FNP-CISL Secretariat of Ferrara, we believe it is appropriate to inform all pensioners who have sent registered letters to INPS of the unfortunately negative outcome of a period of expectation in which we believed.
