On Easter holidays, FILCAMS-CGIL, FISASCAT-CISL and UILTuCS-UIL regional declare abstention from work for the days of April 25, 2018 Anniversary of Liberation, May 1, 2018 Labor Day, June 2, 2018 Proclamation of the Republic INVITING workers in the retail sector and those involved in all activities carried out within shopping centers TO JOIN IN BY ABSTAINING FROM WORK ON THE HOLIDAYS!
Availability to work on holidays is a free and autonomous choice of workers. Recent rulings confirm our position, according to which the employer cannot force the employee to work on a holiday and defines as illegitimate any disciplinary sanction as punishment for the refusal to work on a holiday, if there has not been prior consent from the latter.
As is known, the LIBERALIZATION of opening hours introduced in 2011 with the “Salva Italia” Decree eliminated all constraints and rules regarding commercial opening hours, in total disregard of the negative effects produced on millions of people, mainly women, and on their families.
The discussion in the last legislature stopped at the 10th Industry, Commerce and Tourism Commission of the Senate, with a set of regulations that on the one hand allowed local authorities and social partners to renegotiate the opening hours of commercial establishments in the territories, but on the other hand, by not imposing any constraints, except for closing on only 6 holidays, it did not substantially solve the problem. It is necessary that the discussion in Parliament be reactivated for a new regulation of commercial openings!
Liberalizations are wrong, they do not help economic growth, they do not create new jobs, they produce dumping between small and large-scale distribution, they sell off holidays, they empty the historic centers of cities in favor of consumer citadels, they devalue the quality of work by breaking up work performance and forcing employees to work hours that are not very compatible with the need for rest.
For these reasons, the Regional Secretariats invite workers to abstain from work for the entire work shift of the above-mentioned holidays, reminding workers that on the basis of the current contractual provisions, and in light of recent rulings by the Court of Cassation, they may refuse to perform work on all holidays, without incurring any sanctions.
