As is known, on November 26, the Court of Justice issued its ruling regarding the illegitimacy of the indiscriminate and unlimited reiteration of fixed-term teachers' contracts.

For this reason, tomorrow, December 12th, a clarification meeting will be held at 2:30 PM at the CISL headquarters in Corso Piave 60, in the presence of lawyers Paolo Picci and Alessandro Pace, with temporary teachers and ATA staff interested in filing an appeal for stabilization and compensation.

In general, the renewal of fixed-term contracts must be justified by "objective reasons" (specifically, concrete needs such as the absence of the holder due to illness, maternity, etc.) and there must be rules that allow for adequate verification of the existence of objective reasons.

Such objective reasons do not exist in the case of contract renewals (30 June, 31 August) for more than 36 months in total.

In the sentence The Court of Justice clearly states that Italian law is completely lacking in any regulation governing the stipulation of fixed-term employment contracts that protects workers from the abuse of repetitive contracts. This legislation also fails to provide for compensation for damages, thus violating the treaty provisions. Regarding the dispute, the CISL Scuola (Italian Confederation of Schools) of Ferrara, through the law firm of Paolo Picci, has already filed appeals with the labor court, and we are awaiting the ruling on the merits, which should take into account the position expressed by the Court of Justice. We believe that litigation can be initiated against those who have not yet filed an appeal.
