Regarding the Carife dispute, I would like to inform you that, as Adiconsum, we are preparing a series of measures to ensure the broadest possible protection for citizens. It's important to clarify from the outset that our goal is to provide information and oversight on what's happening and the implications of the Carife dispute. Our goal is to ensure clarity and justice. This doesn't necessarily mean that shareholders will receive their stolen goods back!
First, we prepared a formal notice to Carife SpA, requesting a copy of the documentation relating to the purchased securities, with the assistance of the law firm of Paolo Picci.
Once citizens' support has been gathered, an invitation to participate in the mediation procedure will be extended to all those excluded from the arbitration provided for by the proposed laws.
For the "lucky secondary bondholders" admitted to this latter procedure, Studio Picci will work alongside the consumer to ensure the best possible compensation based on the rules that will be established.
For potential legal action, the range remains quite broad, and we reserve the right to inform consumers of the choices that Picci Law Firm, in conjunction with us, intends to make, especially given the costs involved (which are certainly higher for civil cases requiring a unified fee, expert reports, court-appointed expert witnesses, judgment registration fees, etc., which can be claimed both by savers against the bank and by shareholders against former directors) and the difficulty of obtaining favorable judgments, especially for shareholders.
For those interested, please note that the cost of initiating and joining the procedure, payable to the Association, is €85 for CISL members and €100 for non-members. This fee includes, in addition to the Adiconsum membership fee, the fee for the Picci Law Firm (€50.00 including expenses + 4% cnap), which will oversee the entire preliminary phase up to and including mediation-arbitration (this activity will be subject to specific financial agreements between consumers, the association, and Attorney Picci based on the value of the claim). This fee includes the study of the case, drafting of letters, acquisition and management of case files, updates on the situation, and any mediation proposals. This obviously does not entail any obligation to proceed to court. A case-by-case assessment will be made subsequently, also based on ad hoc appraisals of individual cases (which will obviously have an additional cost, also to be agreed upon). However, it is premature to talk about legal proceedings.
All the above information is always communicated to members and the costs will be expressly specified in individual conversations with those who show interest in taking action with us to protect their rights.
