We inform CariFe savers involved in various capacities in the cancellation of shares and subordinated bonds, that there is important news regarding the possible compensation for the damage suffered by each individual saver.
Regarding the criminal proceedings involving several former CariFe executives, following the preliminary hearing on 19 December 2017, all the defendants have been sent for trial, and the first hearing has been set for June 18, 2018. It will therefore be possible for all those who have not yet done so through ADICONSUM, to constitute itself as a civil party in the above-mentioned criminal proceedings, in order to request compensation for the damage suffered as a result of the conduct of the defendants that led to the collapse of CariFe and the loss of their savings invested in shares and subordinated bonds. Anyone who intends to proceed with the constitution of a civil party may therefore do so by registering with ADICONSUM no later than April 30th, bringing with him all the banking documentation in his possession relating to the purchase of the shares and subordinated bonds, as well as a valid document.
We also inform all savers that a special counter has been set up at ADICONSUM for all CariFe savers, who will receive you by making an appointment by calling no. 349/7963706 and where there will be a qualified operator and a lawyer from the law firm of Avv. Paolo Picci, who will provide you with all the most useful information and directions on how to proceed to protect your right to savings.
We would like to point out from now, in fact, that the constitution of civil party is not in fact the only viable path, but, depending on the different positions and needs of the individual saver, which will be fully analyzed by ADICONSUM and the Picci Law Firm, the individual saver may be directed to promote arbitration at Consob (through the ACF) or to file an independent civil proceeding at the Court.
Finally, we inform you that the Government should soon issue the implementing decrees outlining the procedure and timing of access to the Compensation Fund for victims of banking crimes of 100 million Euros (over four years) allocated by the 2018 Budget Law. At ADICONSUM, therefore, as soon as these decrees are issued, you can be fully informed about the access methods, and you will be individually followed at each step by qualified ADICONSUM personnel and the Picci Law Firm, in order to allow the saver to obtain the financial compensation that will be due to him within the limits and under the conditions established in the aforementioned decree.
Finally, we remind you that ADICONSUM has always been at the side of savers, and in this regard we highlight the extrajudicial and judicial initiatives implemented up to now to protect "betrayed" savings, in collaboration with the law firm of Avv. Paolo Picci:
– as regards the criminal proceedings, ADICONSUM and the law firm Avv. Paolo Picci have filed around one hundred complaints and complaintspedeutics to the subsequent constitution of a civil party that ensued on the occasion of the preliminary hearing that ended on 19 December; we have therefore already proceeded to have approximately 85 injured parties constituted as civil parties, on the occasion of the initiation of the criminal trial, damaged in various ways by the crimes charged by the Public Prosecutor's Office of Ferrara to several former CariFE managers;
– with regard to the civil initiatives undertaken to protect savings, the following activities should be highlighted:
– In the autumn of 2016, Adiconsum Ferrara took action, with a favorable outcome for all members, to protect approximately 400 positions of subordinated bondholders with the requirements set out in Ministerial Decree 83/2017, by formulating requests for lump-sum compensation, equal to 80% of the consideration paid for the purchase of the financial instruments, to the FITD;
– ADICONSUM and the Law Firm of Avv. Paolo Picci, in the autumn of 2017, then took care of preparing the appeals for access to the Solidarity Fund through arbitration proceedings – currently still being examined by the Anac Board – on behalf of subordinated bondholders who do not meet the requirements to access thelump sum compensation equal to 80%.
